Why state sportsbooks are illegal in Texas
Texas Penal Code Chapter 47 restricts gambling, and the Texas constitution would need to be amended to authorize commercial sports betting. Bills have been filed every legislative session — including well-funded pushes from major sportsbook operators — and all have failed. Lt. Governor Dan Patrick has been the most consistent block in the Senate. The next legislative session is 2027.
Why event contracts ARE legal in Texas
CFTC-regulated event contracts are federal derivatives, not state gambling. They're regulated under the Commodity Exchange Act by the same federal agency that oversees oil futures and interest-rate swaps. Federal commodity law preempts state gambling statutes — so Texas Penal Code Chapter 47 doesn't apply.
The October 2024 D.C. Circuit ruling in Kalshi's favor confirmed this legal pathway. Texas has not taken enforcement action against any CFTC-regulated event contract exchange.
